The Real Estate Agent's Guide to Becoming a Licensed Mortgage Loan Originator:

What if the most valuable opportunity in your real estate business isn't your next listing, but the clients you've already helped buy a home?

Real estate professionals invest considerable time, money, and energy building relationships, generating leads, and guiding buyers through one of life's largest financial decisions. Yet, once a transaction closes, many agents unknowingly surrender a significant portion of that client's future mortgage opportunities to someone else.

At Texana Bank, we believe real estate agents should have the opportunity to participate in more of the mortgage transactions generated by the relationships they have worked so hard to establish.

Through our Real Estate Mortgage Loan Originator (REMLO) program, qualified real estate professionals can become mortgage loan originators while continuing their real estate careers. This dual-capacity model creates opportunities to earn additional compensation, expand professional services, and build a business that extends well beyond traditional real estate commissions.

For agents looking to diversify income, strengthen client relationships, and position themselves for the future of real estate, becoming a mortgage loan originator may represent one of the most significant professional opportunities available today.

What Is a Real Estate Mortgage Loan Originator (REMLO)?

A Real Estate Mortgage Loan Originator (REMLO) is a qualified real estate professional who also works as a mortgage loan originator, allowing that individual to participate in both real estate and mortgage lending activities within applicable federal and state regulations.

Traditionally, real estate agents and mortgage loan originators operated as separate professionals. Agents facilitated property purchases and sales, while mortgage professionals assisted buyers with obtaining financing.

Although these professionals worked closely together, their compensation and responsibilities remained separate.

Today, eligible agents can pursue a dual-capacity career that combines these services.

Through Texana Bank's REMLO program, qualified agents become mortgage loan originators employed by a federally regulated banking institution while maintaining their separate real estate careers.

This creates an opportunity to participate in mortgage transactions involving:

    • Home purchases: Financing for clients purchasing primary residences, second homes, or investment properties.

    • Mortgage refinances: Helping existing homeowners evaluate opportunities to replace their current mortgage.

    • Cash-out refinances: Assisting eligible homeowners seeking access to accumulated home equity.

    • Home equity lines of credit (HELOCs): Providing financing options for homeowners who want to access available equity.

    • Investment property financing: Supporting real estate investors with eligible financing solutions.

    • Out-of-state transactions: Maintaining mortgage relationships with clients purchasing or refinancing properties in other states.

Rather than limiting client engagement to the purchase or sale of a property, REMLOs can participate in mortgage-related conversations throughout the homeowner's financial journey.

Can a Real Estate Agent Also Be a Mortgage Loan Originator?

One of the most common questions among real estate professionals is whether an agent can legally serve as both the real estate agent and mortgage loan originator on the same transaction.

The answer is yes, under qualifying circumstances and subject to applicable program requirements, compensation rules, disclosures, and conflict-of-interest safeguards.

Historically, certain mortgage programs restricted or prohibited dual compensation for professionals participating in both real estate sales and mortgage origination.

Over time, federal housing agencies clarified aspects of their policies concerning dual employment and compensation.

HUD's Mortgagee Letter 2022-22, for example, revised FHA policy to permit individuals with dual employment to participate in qualifying FHA transactions, subject to applicable restrictions and safeguards.

The broader mortgage marketplace also includes conventional financing through Fannie Mae and Freddie Mac and eligible VA lending oppor
